Pandey, learned Additional Chief Standing Counsel and Sri Suresh Chandra Dwivedi, learned Standing Counsel for the State through Video Conferencing.
The petitioners have preferred the present writ petition inter-alia with the prayer to issue a mandamus directing the respondents to provide 10 % reservation of the sub-category i.e. E.W.S. (Economically Weaker Section) to the petitioners in the selection proceedings undertaken by the respondents relating to the selection of 69000 posts of Assistant Teachers to be appointed in different Primary Schools of different districts of the State of U.P.
It is argued by the learned counsel for the petitioners that the Government has already issued a Government Order on 13.8.2019 whereby 10% reservation has been provided to the persons belonging to the Economically Weaker Section in all categories of Government Services in direct recruitment. It is further argued that though the Government Order dated 13.5.2020 was issued, copy of which is appended as annexure 5 to the writ petition, but while issuing the online application form pursuant to the aforesaid Government Order, the Government Order dated 13.8.2019 for the purpose of reservation was not at all taken into consideration.
The matter requires consideration.
On the request made by learned counsel for the respondents, three week's time is granted to file counter affidavit. Rejoinder affidavit, if any, may be filed within one week, thereafter.
List this matter on 01.07.2020 before the appropriate Bench.
